The Law: Using Federal and State Codes and Cases....: For Education

How many times have you started to write a research paper and wondered what does the law say about this?

Trials, Cases or the Education Code

Situation:  You are a student working on your Teaching Certificate.  You hear that students can no longer grade each other's papers.

You wonder how this happened.  You are referred to the Owasso v. Falvo (peer grading) case.  How do you find this?

Here are some other cases that might interest you as you take Education classes:

  • The Scopes Trial or Monkey Trial
  • Education Code

Owasso v. Falvo

After opening the Library Database called Lexis-Nexis Academic

  1. Use the Look up a Legal Case box
  2. Using the By Parties search, type in "Owasso" in the first box and "Falvo" in the box following the v.
  3. Click Go   
  4. Eleven hits are retrieved.  This case was decided in 2002.

Scopes Trial or Monkey Trial (1925)

After opening the Library Database called Lexis-Nexis Academic

  1. Click on the US Legal tab on the left
  2. Then click on Federal & State Cases 
  3. In the search box that appears, search the name "Scopes" in Party Names  
  4. In the second search box, search for "evolution" in Everywhere  
  5. Two hits are retrieved.
  6. What has happened since then?  Schools are teaching about evolution now.

Education Code (Federal or State) -- Picking State Statutes, Codes and Regulations

After opening the Library Database called Lexis-Nexis Academic

  1. Click on the US Legal tab on the left.
  2. Click on Federal Statutes, Codes & Regulations.   
  3. Browse the Annotated US Code and find the Education Code (Title 20) section.
  4. Click on the Education Code and then search for the topic that you with to find.

You will probably find better results by searching the state codes (Texas)

  1. In Lexis-Nexis Academic, again click on the US Legal tab.
  2. Click on State Statutes, Codes & Regulations.   
  3. Pick the state Texas and the browse the Statutory Code to find the Education Code   
  4. Search the Education Code for the subject that you are interested in.
